Recently, the trade organization (WTO) published a draft regulation from the European Union (EU), which aims to formulate new rules for food contact recycled plastics, which is attached in WTO No. 21-9180 document and in G/SPS/N/ Announced in document EU/524, which contains the following important elements:
· Description of the range and sources of recycled plastic materials and products;
· Formulate regulations for placing food contact recycled plastics on the market, regulations on the recycling process of food contact recycled plastics, and regulations on the use of food contact recycled plastics;
EU proposes new regulations for food contact recycled plastics, expected to take effect in July 2022 (Figure 1)
· Provisions for appropriate recycling techniques;
· Requiring that recycled plastic materials and products meet a range of criteria when placed on the market, this includes composition requirements and Chapters II and V of Regulation EU No 10/2011 on Plastics for Food Contact (Consolidated September 2020) requirements, these rules do not apply to potential residual contamination in recycled plastic materials and products;
· Product instructions, instructions for use, or labels need to detail recycled plastics for food contact;
· Detailed requirements for plastic waste management operators, including waste collection, decontamination, subsequent treatment and use of recycled plastic, and implementation of recycling programs;
· Prescribe and list criteria for developing new recycling technologies;
· Recyclers are required to provide a Declaration of Compliance (ie DOC, see Part A of Annex III of the draft regulation).
If adopted, the draft Regulation will repeal Regulation (EC) No 282/2008 on Recycled Plastics in Food Contact (Consolidated October 2015). According to the WTO notification, the draft regulation is proposed to:
